About These Terms & Conditions

These Terms & Conditions govern your use of the Precision SmartWeb LLC website, communications, and services. The specific services provided to each customer depend on the package, features, configuration, and any separate service agreement or order selected by that customer.

Our services may use artificial intelligence, automated workflows, third-party software, communications platforms, and other technology to assist with tasks such as responding to inquiries, capturing leads, scheduling appointments, sending notifications and follow-ups, and managing customer communications.

Features and capabilities may vary depending on the customer's selected services, configuration, third-party providers, telecommunications carriers, and other technical requirements. Precision SmartWeb does not represent that every available feature or automation is included with every service package.

Customer Responsibilities

Customers are responsible for providing accurate, complete, and current information needed to configure and operate their Precision SmartWeb services. This may include business information, services offered, hours of operation, contact information, scheduling preferences, service areas, policies, branding materials, and other information necessary for the selected services.

Customers are responsible for reviewing and approving their website content, AI Personal Assistant configuration, automated workflows, communications, and other configured services before or during activation, as applicable. Customers should promptly notify Precision SmartWeb of changes that may affect how their services should operate.

Customers are also responsible for using Precision SmartWeb services in compliance with applicable laws, regulations, carrier requirements, platform policies, and any additional agreements applicable to their business or industry.

Payments, Billing & Subscriptions

Fees for Precision SmartWeb services are based on the service package, subscription, project, or other arrangement selected by the customer. Applicable pricing, billing frequency, setup fees, and other charges will be disclosed before purchase or activation.

For recurring services, customers authorize the applicable payment method to be charged according to the agreed billing schedule until the subscription or service is canceled or otherwise terminated in accordance with the applicable agreement.

Customers are responsible for maintaining accurate billing and payment information. Failure to make required payments may result in suspension or termination of services. Additional terms concerning cancellation, refunds, minimum commitments, website ownership, domains, telephone numbers, or other service-specific matters may be included in a separate service agreement or order and will apply when accepted by the customer.

AI Personal Assistants & Automated Services

Precision SmartWeb services may include artificial intelligence, AI Personal Assistants, automated workflows, and other technology designed to assist with customer communications and business tasks. These systems are configured using information, instructions, and preferences provided or approved by the customer.

Artificial intelligence and automated systems may occasionally produce inaccurate, incomplete, unexpected, or inappropriate responses or results. Precision SmartWeb does not guarantee that AI-generated responses or automated actions will be error-free or suitable for every situation.

Customers remain responsible for reviewing their business information, instructions, workflows, and communications and for notifying Precision SmartWeb when changes or corrections are needed. AI Personal Assistants and automated services are intended to assist business operations and are not substitutes for professional legal, medical, financial, emergency, or other licensed professional advice.

Appointments & Scheduling

Precision SmartWeb services may include appointment scheduling, calendar integration, reminders, notifications, and related automated features. Appointment availability and scheduling information may depend on the hours, calendar settings, availability, and other instructions provided by the customer.

Customers are responsible for keeping their scheduling information accurate and current. Precision SmartWeb does not guarantee that every appointment request, reminder, notification, or calendar action will be successfully delivered or completed, as these services may depend on internet connectivity, telecommunications carriers, third-party platforms, customer configurations, and other factors outside our direct control.

Customers remain responsible for reviewing their calendars, appointments, and business communications and for promptly notifying Precision SmartWeb of any configuration changes or issues that may affect scheduling.

Third-Party Services & Technology

Precision SmartWeb services may use or integrate with third-party platforms, software, telecommunications providers, payment processors, hosting providers, scheduling systems, artificial intelligence providers, and other technology services.

These third-party services may have their own terms, policies, availability requirements, fees, and operating limitations. Precision SmartWeb does not control and cannot guarantee the continuous availability, performance, security, or functionality of services provided by third parties.

From time to time, third-party providers may modify, suspend, discontinue, or restrict features that affect a Precision SmartWeb service. When reasonably possible, Precision SmartWeb may adjust configurations or recommend alternatives, but we are not responsible for interruptions, changes, or failures caused by third-party services outside our control.

Intellectual Property

The Precision SmartWeb name, branding, logos, website content, graphics, videos, written materials, software configurations, workflows, templates, designs, and other materials created or owned by Precision SmartWeb LLC are protected by applicable intellectual property laws and may not be copied, reproduced, distributed, sold, or used without authorization.

Customers retain ownership of the business information, logos, photographs, written materials, and other content they provide to Precision SmartWeb, subject to any rights necessary for us to use those materials to provide the requested services.

Ownership and usage rights for websites, domains, telephone numbers, custom materials, or other assets created or managed as part of a customer service package may be further described in the applicable service agreement, order, or subscription terms.

Service Availability & Changes

Precision SmartWeb works to provide reliable and useful services, but we do not guarantee that our website, AI Personal Assistants, automations, communications, or other services will operate without interruption, delay, error, or temporary unavailability.

Services may occasionally be affected by maintenance, updates, internet or telecommunications disruptions, third-party platforms, carrier networks, software changes, equipment failures, or circumstances outside our reasonable control.

Precision SmartWeb may modify, update, replace, or discontinue features when reasonably necessary to maintain, improve, secure, or adapt our services. When a material change affects a customer's purchased service, we will make reasonable efforts to communicate the change and, when practical, provide an appropriate alternative.

Acceptable Use

You agree to use the Precision SmartWeb website and services only for lawful business purposes and in accordance with these Terms & Conditions and applicable laws, regulations, carrier requirements, and platform policies.

You may not use our services to send unlawful, fraudulent, deceptive, abusive, threatening, harassing, or unsolicited communications; impersonate another person or business; interfere with or damage our systems or services; attempt unauthorized access to accounts, systems, or data; or use our services in a manner that violates the rights of others.

Precision SmartWeb may suspend or terminate access to services when we reasonably believe they are being used unlawfully, fraudulently, abusively, or in violation of applicable requirements or these Terms & Conditions.

SMS & Text Message Communications

If you provide your mobile phone number and separately consent to receive text messages from Precision SmartWeb LLC, we may send text messages consistent with the type of communications you agreed to receive. These may include appointment information, service updates, customer support communications, follow-ups, and, when separately authorized, marketing or promotional messages.

Consent to receive text messages is not a condition of purchasing any goods or services. Message frequency may vary. Message and data rates may apply. You may opt out of text messages at any time by replying STOP. For assistance, reply HELP or contact Precision SmartWeb at [email protected].

Your consent applies only to the communications you have agreed to receive and is not transferred or sold to another business for its marketing purposes. Wireless carriers are not liable for delayed or undelivered messages. Please review our Privacy Policy for additional information about how we collect, use, and protect your information.

Cancellation, Suspension & Termination

Customers may cancel services in accordance with the cancellation terms applicable to their service package, subscription, order, or separate service agreement. Certain services may be subject to minimum commitments, notice requirements, outstanding balances, or other conditions disclosed at the time of purchase.

Precision SmartWeb may suspend or terminate services for nonpayment, unlawful or abusive use, violation of these Terms & Conditions, violation of applicable carrier or platform requirements, or other circumstances that reasonably threaten the security, operation, or integrity of our services.

Termination or cancellation does not eliminate payment obligations or other responsibilities that arose before the effective date of termination. Provisions that by their nature should continue after termination, including provisions concerning intellectual property, payment obligations, disclaimers, and limitations of liability, will remain in effect.

Disclaimers & Limitation of Liability

Precision SmartWeb provides its website and services using commercially reasonable efforts, but we do not guarantee specific business results, revenue, sales, leads, appointments, customer reviews, search rankings, or other outcomes from the use of our services.

To the fullest extent permitted by applicable law, Precision SmartWeb LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of, inability to use, or reliance upon our website or services, including losses resulting from interrupted communications, missed opportunities, third-party service failures, or inaccurate or unexpected automated or AI-generated responses.

Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.

Governing Law

These Terms & Conditions and any dispute arising from or relating to the Precision SmartWeb website or services will be governed by the laws of the State of Georgia, without regard to its conflict-of-law principles.

Any legal action or proceeding arising from these Terms & Conditions or our services will be handled in a court of competent jurisdiction as permitted by applicable law.

Nothing in this section prevents Precision SmartWeb LLC or a customer from attempting to resolve a disagreement informally before pursuing other available remedies.
